Robert Biel of Brevard County has been sentenced to one year in state prison for having junk in his yard. A judge ordered the sentence because Biel had been on probation for having junk in his yard and failed to clean it up.
What’s controversial is what qualifies as junk. Brevard County code enforcement has been dealing with Robert Biel for over a decade trying to get him to clean up what they say is junk. But Biel argues it is not junk, just his personal stuff that he uses or collects and that the county has been harassing him and his rights have been violated.
“It’s my own stuff on my own property,” Biel said.
Upon his release, he will still be on probation and required to clean up his property. Exactly how far a property owner can go in collecting “stuff” has yet to be decided at a higher level court.
